2. Service Description
ListSeek.ai provides: - Real-time search engine results page (SERP) monitoring - Brand mention detection and ranking analysis - Keyword tracking across search engines - AI-powered content classification - Data export and reporting tools
2.1 Service Availability
We strive to maintain continuous service availability. However, we do not guarantee uninterrupted access and may suspend the service for maintenance, updates, or technical issues. We are not liable for any downtime or service interruptions.
3. User Accounts
3.1 Registration
To use ListSeek.ai, you must: - Be at least 18 years old - Provide accurate and complete registration information - Maintain the security of your account credentials - Notify us immediately of any unauthorized access
3.2 Account Responsibility
You are solely responsible for: - All activities conducted through your account - Maintaining the confidentiality of your password - Ensuring your account information remains current and accurate
4. Credits System
4.1 Credit Allocation
- New users receive 5 free credits upon registration
- 1 keyword search with 10 results = 1 credit
- Credits are consumed upon launching a search, regardless of results
4.2 No Refunds
Credits are non-refundable. Once consumed, credits cannot be refunded even if: - Search results are unsatisfactory - The service experiences temporary issues - You decide not to use the service
4.3 Service Failures
If searches fail due to technical issues on our end, we will make reasonable efforts to resolve the problem as quickly as possible. However, credits consumed during failed searches are not automatically refunded.
5. Acceptable Use
5.1 Permitted Use
You may use ListSeek.ai for: - Monitoring your own brand presence in search results - Competitive analysis and market research - SEO strategy and optimization - Client reporting and analytics
5.2 Prohibited Use
You must NOT: - Violate any applicable laws or regulations - Infringe upon intellectual property rights - Attempt to reverse engineer or compromise our systems - Use automated tools to access the service beyond normal usage - Resell or redistribute our service without authorization - Use the service to harm, harass, or defame third parties - Circumvent usage limits or credit restrictions - Share your account credentials with unauthorized parties
6. Intellectual Property
6.1 Our Rights
ListSeek.ai, including all software, algorithms, designs, and content, is protected by intellectual property laws. All rights, title, and interest remain with Listseek.ai.
6.2 Your Data
You retain ownership of: - Keywords and brand names you submit - Projects and configurations you create
We retain the right to use aggregated, anonymized data for service improvement and analytics.
7. Third-Party Services
Our service integrates with: - SerpAPI - Search results data - OpenAI - AI-powered content classification - SendGrid - Email delivery
Your use of these services through ListSeek.ai is subject to their respective terms and conditions.
8. Limitation of Liability
8.1 No Warranties
ListSeek.ai is provided "AS IS" and "AS AVAILABLE" without warranties of any kind, express or implied, including but not limited to: - Accuracy of search results or rankings - Completeness of data collected - Availability or reliability of the service - Fitness for a particular purpose
8.2 Disclaimer of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, LISTSEEK.AI SHALL NOT BE LIABLE FOR:
- Indirect, incidental, or consequential damages
- Loss of profits, revenue, or business opportunities
- Data loss or corruption
- Third-party actions based on data provided by our service
- Decisions made based on information from our service
8.3 Maximum Liability
Our total liability to you for any claim arising from your use of ListSeek.ai shall not exceed the amount you paid us in the 12 months preceding the claim, or €100, whichever is less.
9. Data and Privacy

10. Data Retention
10.1 Search Results
Search run data and results are retained for 1 year from the date of the search, after which they may be automatically deleted.
10.2 Account Data
Upon account deletion, we will: - Delete your personal information within 30 days - Retain anonymized analytics data as permitted by law - Honor any specific deletion requests under GDPR
11. Termination
11.1 By You
You may terminate your account at any time through your account settings. Unused credits are forfeited upon termination.
11.2 By Us
We may suspend or terminate your account if: - You violate these Terms - You engage in fraudulent or illegal activity - Your account remains inactive for an extended period - Required by law or court order
12. Changes to Terms
We may update these Terms at any time. Material changes will be notified via: - Email to your registered address - Notice on our website
Continued use of the service after changes constitutes acceptance of the new Terms.
13. Governing Law
These Terms are governed by French law. Any disputes shall be subject to the exclusive jurisdiction of the courts of Marseille, France.
14. Dispute Resolution

14.2 Arbitration
If informal resolution fails, disputes may be resolved through arbitration in accordance with French arbitration rules.
15. Severability

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Listseek.ai regarding the use of our service.
